1. Acceptance of Terms & Ordering
By placing an order with Printfly, you are making an offer to purchase products or services for the price specified on our website or in a formal quotation. You acknowledge that by placing this order, you are agreeing to pay for and accept delivery of the goods.
We reserve the right to accept or reject your offer for any reason, including the unavailability of a product, an error in pricing or product description, or an error in your order. All orders are subject to our final approval. We only accept orders for delivery within New Zealand.
2. Quotations, Pricing & Payment
2.1. Quotations
All quotations provided by Printfly are valid for 30 days from the date of issue. After this period, we reserve the right to re-quote.
2.2. Prices
All prices are in New Zealand Dollars (NZD) and are exclusive of Goods and Services Tax (GST) unless otherwise stated. Prices published on our website are subject to change without notice.
2.3. Payment
Unless a credit account has been formally approved in writing, full payment is required at the time of placing your order. We accept payment via the methods specified on our website. Work will not commence until payment has been received in full.
2.4. Overdue Accounts
For approved account holders, if payment is not received by the due date, we reserve the right to charge interest on the overdue amount at a rate of 5% per month. We may also engage a third-party collection agency, and you agree to be liable for any legal or collection charges incurred in the pursuit of your overdue account.
3. Artwork, Proofs & Colour Matching
3.1. Artwork Submission
It is your responsibility to supply print-ready digital files that meet our specifications (e.g., CMYK colour mode, 300dpi resolution, correct bleed and trim marks). We are not responsible for errors resulting from incorrectly supplied artwork. It is also your responsibility to retain a backup copy of any file you supply.
3.2. Proof Approval
We will not proceed to print until we have received your written approval of the final proof (via email or our online portal). The proof is your final opportunity to check for errors. Once you approve the proof, you accept full responsibility for the layout, spelling, grammar, punctuation, and content. Printfly is not liable for any errors in the finished work that were present on the approved proof.
3.3. Colour Matching
We will use our best endeavours to produce a commercially acceptable colour match. However, we cannot guarantee an exact match with colour proofs, your screen, or previously printed materials due to variations in substrates, printing processes, and calibration.
3.4. Artwork Changes
Once an order is placed, you have one (1) hour to notify us of any changes to the artwork. After this time, any changes may incur additional charges.
4. Prohibited & Copyrighted Material
4.1. Prohibited Content
We will not print any material that, in our sole opinion, is illegal, libellous, defamatory, obscene, pornographic, abusive, or otherwise inappropriate.
4.2. Copyright
By submitting your artwork, you warrant that you are the owner of or have express permission to use any copyrighted or trademarked material it contains. You agree to indemnify Printfly against any claims, costs, and expenses arising from any breach of copyright, patent, or design.
5. Production, Delivery & Quantity
5.1. Turnaround Times
All delivery and turnaround times are estimates. We will make every effort to deliver on time, but we accept no liability for any loss arising from delay or error in the delivery of goods.
5.2. Delivery
The risk in the goods passes to you upon delivery to your specified address or to the carrier. You are responsible for providing a correct and complete delivery address.
5.3. Quantity Variation
We shall be deemed to have fulfilled our contract by delivering a quantity within a 5% plus or minus tolerance of the quantity ordered. You will be charged at the contract rate for the actual quantity delivered.
6. Claims, Refunds & Liability
6.1. Examination of Goods
You must examine all goods upon delivery. Any claims for damage, delay, or partial loss in transit must be noted on the delivery note at the time of delivery and communicated in writing to us at sales@printfly.co.nz within five (5) working days of receipt.
6.2. Quality or Quantity Claims
All claims regarding the quality or quantity of the goods must be made in writing to us within five (5) working days of receipt. Failure to do so will mean the goods are deemed to have been accepted as compliant with the contract.
6.3. Return of Goods
Printfly requires any allegedly defective goods to be returned to us in full before we consider a reprint or refund. If we deem the printing to be of sufficient quality and within acceptable tolerances, we reserve the right to return the goods to you and refuse a reprint or refund.
6.4. Limitation of Liability
Our liability for any loss or damage in respect of the goods shall be limited to the contract value of the goods. We will not be liable for any indirect, consequential, or financial loss (including loss of earnings) arising from errors, delays, or third-party claims. We reserve the right to rectify defective work by reprinting and shall not be automatically liable for a refund.
6.5. Consumer Guarantees Act 1993
Where you are acquiring the goods for the purposes of a business, you agree that the provisions of the Consumer Guarantees Act 1993 do not apply to the supply of goods under this agreement.
7. Cancellation
If you cancel your order, you will be invoiced for any costs incurred by Printfly for work or materials up to the date of written cancellation. If the order has been paid for, these costs will be deducted before any refund is issued.
8. Title of Goods
All goods remain the property of Printfly until payment has been received in full. In the event of non-payment, we are entitled to enter your premises to repossess and remove the goods.
9. General
9.1. Force Majeure
We will not be held responsible for any failure or delay arising from causes outside our reasonable control, including but not limited to acts of God, industrial disputes, equipment failure, or inability to procure materials.
9.2. Governing Law
This agreement shall be governed by and construed in accordance with the laws of New Zealand.
